I'm sure an Oracle lawyer would find a way to argue against that. As the patent debate has taught us, it's not actual infringement but the threat of litigation that really stops a business from doing something.
If you're thinking about changing licensing, you should seriously consider the problem of companies who don't redistribute at all, but expose your functionality over a network. The AGPL has some definite advantages in that respect.
